How Georgia taxes your crypto gains

Georgia switched to a flat income tax in 2024 and keeps cutting the rate. For tax year 2026 the rate is 4.99%, reduced from 5.19% by HB 463, which Governor Kemp signed in May 2026 and made retroactive to January 1, 2026. Crypto gains are taxed as ordinary income at that flat rate, with no long-term discount.
The Georgia Department of Revenue receives your federal return data, so the capital gains you report to the IRS are the same numbers Georgia expects on Form 500. HB 463 also schedules further reductions in the years ahead, so the rate is a moving figure worth confirming before you file.
Georgia has no county or city income tax, so a crypto trader in Atlanta pays the same 4.99% as one in Savannah. Part-year and nonresident traders file Form 500 and prorate gains based on Georgia residency during the year.
