How South Carolina taxes your crypto gains

South Carolina rewrote its income tax for 2026. H.4216, signed March 30, 2026, replaced the old three-bracket schedule with two brackets: 1.99% on taxable income under $30,000 and 5.21% on income at or above $30,000. Crypto gains are taxed as ordinary income at these rates.

The big lever for crypto investors is South Carolina's 44% net capital gains deduction under Code Section 12-6-1150. If you held the coin more than one year, only 56% of the gain is taxed, which drops the effective top rate on long-term crypto gains to about 2.92% for 2026. Short-term gains, held one year or less, get no deduction and are taxed at the full rate up to 5.21%. Holding period is everything here, so cost basis and acquisition dates have to be exact.

H.4216 also decoupled South Carolina from federal deductions. Federal adjusted gross income is now the starting point on Form SC1040, with a new South Carolina Income Adjusted Deduction replacing the old federal standard deduction. The Department of Revenue administers all of this and receives your federal data.
