HB 252 restructured the brackets starting in tax year 2025, so for 2026 single filers pay six rates from 1.5% up to 5.9%, with the top rate kicking in at $210,000 of taxable income. The brackets are not indexed to inflation, so a big trading year pushes you up the schedule fast.

The bigger story for investors is the capital gains deduction. New Mexico used to let you deduct the greater of $1,000 or 40% of net capital gains. HB 252 gutted that. For 2025 and 2026, non-business gains are capped at a $2,500 deduction, and the 40% break now only applies to the sale of a New Mexico business. Crypto gains are non-business gains, so you shave off at most $2,500 and the rest is taxed as ordinary income on Form PIT-1.

The Taxation and Revenue Department receives your federal return data and matches it against what you file. New Mexico-specific considerations

Capital gains break gutted

HB 252 capped New Mexico's capital gains deduction at $2,500 for non-business gains starting in 2025. The old 40% deduction now only covers the sale of a New Mexico business, so nearly all of a crypto gain is taxed at ordinary rates.

Community property

New Mexico is a community-property state. Crypto bought during a marriage generally splits between spouses, which affects separate filings and any divorce involving digital assets.

Brackets not indexed

New Mexico's brackets do not adjust for inflation. A strong trading year can push you toward the 5.9% top rate at $210,000 without any change in the law.
