How Washington taxes your crypto gains

Washington has no tax on wages or ordinary income. It does tax long-term capital gains. Sell crypto held over a year at a gain, and once your total long-term gains clear the standard deduction ($250,000 base, indexed each year for inflation), a 7% excise applies. Gains above $1 million pay 9.9% after the 2.9% surcharge added by Senate Bill 5813.

The details matter for crypto. The tax reaches only long-term gains, so coins held a year or less fall outside it entirely and pay nothing at the state level. Short-term trading, staking rewards, and mining income are not caught by this excise. Getting your holding periods and cost basis right is what decides whether a sale is even taxable here, which is exactly the reconciliation a crypto tax accountant handles.

Washington-specific considerations

Community property

Washington is a community-property state. Crypto acquired during marriage generally belongs to both spouses, which affects how gains split, how the standard deduction is shared, and how a divorce involving crypto is handled.

Long-term gains only

The excise hits only assets held over a year. This makes holding-period tracking decisive: a coin sold at month eleven is untaxed by Washington, while the same coin sold at month thirteen can be. Clean records decide the outcome.

The $1 million tier

A 2.9% surcharge from Senate Bill 5813 pushes gains over $1 million to a 9.9% rate. Founders and early crypto holders with a large liquidity event can cross this line in a single sale.

Only long-term ones. Washington has no wage income tax, but a 7% excise applies to long-term capital gains above the standard deduction (about $278,000 for 2025, indexed for 2026). Gains over $1 million pay 9.9%. Crypto held a year or less, staking, and mining income are not caught by this excise.
Do I need to file a Washington capital gains return for crypto?
