Why Can't Binance US Generate My Tax Forms?
Many cryptocurrency investors use additional exchanges, wallets, and platforms outside of Binance US. Perhaps you also trade on Coinbase or earn interest from BlockFi. Do you have to pay taxes on Binance.US?
Yes. In the US and most other countries, your Binance.US activity is subject to two kinds of tax:
Capital gains tax. When you dispose of cryptocurrency (selling it, trading one coin for another, or spending it), you recognize a capital gain or loss based on how the price changed since you received it.
Income tax. When you earn cryptocurrency (through staking or referral rewards), you recognize ordinary income equal to its fair market value at the time you received it.
Form 1099-DA for your crypto sales and disposals. 2025 is the first year it issues this form, and it reports your gross proceeds (the total you sold for), not your gain or loss, with no minimum threshold. Cost basis reporting begins for assets acquired on or after January 1, 2026.
Form 1099-MISC if you earned $600 or more in staking, referral, or other rewards. (This threshold rises to $2,000 for the 2026 tax year.)
Binance.US sends copies of these forms to the IRS. Note that Binance.US is the US exchange, a separate company from the global Binance.com, which does not serve US customers. Remember that a 1099 only reflects your Binance.US activity, so it is a starting point, not a complete tax report (see below).
Does Binance.US report to the IRS?
Yes. Binance.US reports to the IRS through the 1099 forms above, filing an identical copy of each with the IRS.
Remember, you owe tax on your Binance.US gains and income whether or not you receive a form. A missing 1099 does not remove the obligation to report.
Why isn't my Binance.US tax report accurate?
Binance.US can only see the activity that happens on Binance.US. Because investors regularly transfer crypto between wallets and exchanges, Binance.US cannot see the original cost basis of coins you moved in from somewhere else, so it cannot calculate your gain or loss correctly, and your 1099-DA can be overstated.
Example: why transfers break your cost basis
Maria buys $2,000 of BTC on another exchange. She transfers it to Binance.US, then later sells it for $2,500 on Binance.US.
Binance.US only sees the $2,500 sale, not the $2,000 Maria originally paid. Without her cost basis, Binance.US cannot tell whether she had a gain or a loss.
